1. Purpose

These terms govern access to the Guyav site and service, whether to the freely accessible surfaces (weekly Briefing, Observatory pages in consolidation mode, editorial and documentary content) or to the contractual engagements (Pilot, Private Observatory). Use of the service implies acceptance of these terms and of the legal notice.

2. Publisher

The service is published by ArtometriX. Full details (legal form, SIREN, trade register, share capital, contact) are listed on the legal notice page.

3. Description of the service

Guyav is a demand-signal intelligence service for luxury, prestige, and challenger brands. It provides:

  • a free weekly Briefing, delivered by email, summarizing regime movements, ruptures, and strategic implications observed in the covered categories;
  • a public Observatory, in consolidation mode, exposing regime classifications (Emerging / Heating / Cooling / Dormant), the ADI (Artometrix Desirability Index), and momentum, volatility, exhaustion, and transition-drift indicators;
  • Pilot and Private Observatory engagements, scoped by quotation, covering one or more analytical categories and a contractually defined brand universe.

Classifications, indices, and briefs constitute a read of the demand signal at the analysis date. They are not investment advice and do not predict commercial or financial performance.

4. Conditions of access

Access to the site requires an internet connection and a modern browser supporting JavaScript. Briefing subscription is by email address, with no password. Access to Pilot and Private Observatory engagements is conditional on the signature of a dedicated agreement.

The user agrees not to:

  • extract, scrape, or index in an automated manner any of the content, indices, or classifications published;
  • circumvent security, rate-limiting, or quota measures;
  • republish, distribute, or present model outputs (regimes, ADI, briefs) as produced by a third party or as detached from their methodology;
  • use the analyses for any purpose contrary to public policy, competition law, or third-party rights.

5. Offers and billing

The Briefing is free of charge, with no commitment, and may be cancelled at any time via the unsubscribe link in each email. Pilot and Private Observatory engagements are offered at fixed scope and fixed fee, by quotation, in accordance with the pricing page. The financial terms, category scope, delivery cadence, and commitment duration of these two offers are defined in a dedicated agreement signed between the parties, which prevails over these terms for matters relating to their execution.

6. Availability of the service

Guyav uses reasonable means to ensure availability of the site and the weekly delivery of the Briefing. Short interruptions may occur for maintenance, updates, model recalibration, or force majeure. No contractual availability commitment applies to the freely accessible surfaces. Service levels applicable to Pilot and Private Observatory engagements are defined in their dedicated agreements.

7. Quality and challengeability of the analyses

In line with the service doctrine, every published output (regime, index, brief) is designed to be traceable to its source signal, lookback window, and reference geography. The system distinguishes between measured signal, interpretive inference, and points not yet sufficiently substantiated to assert.

The user has a path to challenge: any output deemed wrong, miscalibrated, or contrary to observable evidence can be flagged to contact@guyav.com. The publisher undertakes to review substantiated reports within a reasonable timeframe and to publish, where warranted, a correction or a methodology addendum.

8. Intellectual property

All elements of the service (interface, methodology, proprietary indices, database, editorial articles, source code) remain the exclusive property of the publisher or its right holders. Access to a Pilot or Private Observatory engagement grants the user a personal, non-exclusive, non-transferable right to use the deliverables for the duration of the agreement, for internal purposes only, save for written agreement to the contrary.

9. Liability

Analyses, indices, and briefs constitute decision support. The publisher cannot be held liable for any shortfall, media or inventory allocation decision, investment decision, commercial non-realisation, or any other indirect consequence of acting on the published recommendations. Where engaged under a contractual engagement, the publisher's liability is capped at the total amount of fees actually paid by the client over the twelve (12) months preceding the triggering event.

10. Personal data

The processing of personal data collected as part of the Briefing is detailed in section 6 of the legal notice.

11. Modification of these terms

The publisher reserves the right to modify these terms at any time. Material changes will be notified to Briefing subscribers at least thirty (30) days before they take effect. Continued use of the service after that date constitutes acceptance of the new terms.

12. Mediation and dispute resolution

In accordance with article L612-1 of the French Consumer Code, any consumer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute with a professional. Consumers are invited, prior to any such filing, to send a written claim to contact@guyav.com.

13. Governing law and jurisdiction

These terms are governed by French law. Failing amicable resolution, any dispute shall be brought before the competent French courts. Consumers retain the right to bring an action, at their choice, before any court with territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they resided at the time of conclusion of the contract or of the harmful event.
